
In a setback for UK Prime Minister Boris Johnson, the Supreme Court of Great Britain ruled Tuesday that the suspension of parliament was illegal.
Soon after, the president of the House of Commons of Great Britain said parliament will resume its deliberations tomorrow (Wednesday).
Spokesman John Bercow said there will be ample room for emergency discussions following the Supreme Court decision that the suspension of parliament by the government was illegal and void. He said the ruling means that the suspension never went into effect.
He added that there will not be a Prime Minister's Questions session on Wednesday. Prime Minister Johnson is in New York for the United Nations General Assembly. He has refused to say if he will resign if it is discovered that he has violated the law, or if he will try to close the parliament again.
Bercow welcomed the unanimous decision of the Supreme Court and said that British citizens deserve to have a parliament in session to examine the ministers and perform their other central functions.
Sentence of the court
The court considered that the suspension of Johnson's Parliament was "null and void," which means that the parliament was never legally suspended and technically still in session, said the president of the Supreme Court of the United Kingdom, Brenda Hale.
She said lawmakers could decide when to meet again.
"The decision to advise his Majesty to extend the parliament was illegal because it had the effect of frustrating or impeding the ability of the parliament to carry out its constitutional functions without reasonable justification," Hale said.
“The parliament has not been extended. This is the unanimous trial of the 11 judges, ”said Hale. "It is up to the parliament, and in particular the speaker and the speaker, to decide what to do next."
Parliament was suspended, or extended in British jargon, from September 10 to October 14.
The extension was approved by Queen Elizabeth, the politically neutral head of state of Great Britain, who acted on the advice of the prime minister as required under the complex uncoded constitution of the country.
The unanimous decision of the 11 judges is a devastating blow to the government.
The decision followed three days of hearings last week before a panel of 11 judges.
The court rejected the government's claims that the decision to suspend Parliament until October 14 was routine and not related to Brexit. He said that, according to the unwritten constitution of Great Britain, it is the decision of politicians, not of the courts.
Government opponents argue that Johnson illegally closed Parliament a few weeks before the country left the 28-nation bloc for the "inappropriate purpose" of circumventing the scrutiny of lawmakers about their Brexit plans.
They also accused Johnson of cheating the queen, whose formal approval was necessary to suspend the legislature.
Johnson and Parliament have disagreed since he took office in July with the determination to remove Britain from the EU on October 31 with or without a divorce agreement with Europe.
