Sessions judge reluctant to hold judicial probe into Nimirta death case – Pakistan

HYDERABAD: The judge of the district and Larkana's sessions seemed reluctant to conduct a judicial investigation into the mysterious death of Nimirta Mirchandani, a senior BDS student at Bibi Aseefa Dental College, Larkana, who was found dead in her room at the shelter on September 16 in accordance with the request of the department of origin on September 18.

Official police sources in the district said Dawn On Sunday afternoon, the police informed the secretary of the house, Abdul Kabeer Kazi, who travels abroad, about the reluctance of the judges to initiate the investigation. Another source said: "We have learned that the session judge has directly refused to conduct the investigation."

According to the source, it is said that the secretary of the Interior told Larkana police that the judge of the session was supposed to write it down if he was not willing to initiate the investigation. "Things could be clarified on Monday [today]", Added the source.

It is known that an objection by the judge is that the department of origin has made the request directly [the sessions judge] while it is the registrar of the Superior Court of Sindh who has issued said directive.

But even for that matter, no response has been officially communicated to the Larkana police or the department of origin, and it was the message that was transmitted to the police.

Larkana police, meanwhile, remained in a bind. "Neither him [bereaved] the family shows up to present an FIR of the incident and the police are not ready to register a suicide case, "the source said.

The relatives of Nimirta have spoken with Larkana DIG Irfan Ali Baloch and SSP Masood Bungash. A source said that the family had at least demonstrated their confidence in the DIG, but they were still not ready to submit an FIR.

Police have kept two students, Mehran Abro and Wasay aka Ali Shan Memon, in custody for several days to be questioned.

"Obviously, your custody will generate questions and your family can also move a court for release," a police source said.

The statements of the two students have been recorded by the police, who also learned to record their videos.

It is said that Mehran Abro is closely related to Nimirta and, according to the police version, Abro had told the interrogators that he had refused to marry her. A few days before the incident on September 16, she had talked with Professor Amar Lal about her problems.

According to lawyer Ishrat Lohar, a judicial investigation could not be carried out unless a FIR has been registered.

However, lawyer Ali Palh differs from lawyer Lohar and insists that a judicial investigation can be initiated before the registration of an FIR. "The bereaved family wants a superior court judge to lead the investigation," said lawyer Palh.

Nimirta's brother, Dr. Vishaal, did not speak with Dawn despite repeated attempts made by this journalist until Sunday night.
