New Zealand to Change Open Work Visa Rules from April 2026

Immigration New Zealand has announced major changes to open work visa conditions that will come into effect from 20 April 2026. The government said the updates would clarify which types of work visa holders can legally carry out and reduce confusion for immigrants and employers.

Two categories of open work visas

From April 2026, New Zealand will divide open work visas into two clear categories:

that first category Visa holders can work for an employer, be self-employed, or run their own business.

This applies to visa holders such as Partner on a Worker Work Visa, Partner on a Student Work Visa, Post-Study Work Visa and Partner on a New Zealand Work Visa.

that second category Visa holders must only work for their employer. These individuals must have an employment contract or service agreement.

They cannot run their own business. These rules apply to visas including the Domestic Violence Victims Work Visa, Migrant Exploitation Protection Work Visa, Asylum Seeker Work Visa and all working holiday visas.

Working holiday visa regulations have been strengthened.

The government has specified that working holiday makers must start working for their employer from April 2026. They are no longer allowed to run a business or work independently.

Officials say the purpose of the working holiday visa is travel first, work second.

Rules that apply to all visa holders

All open work visa holders must comply with New Zealand employment and business laws. You cannot hire anyone else, even through a business you own.

Authorities also prohibit visa holders from providing or investing in commercial sexual services.

Transition period for current visa holders

Visa holders currently in roles that do not meet the new conditions will be able to continue working until their existing visa expires. However, when applying for a new visa after April 2026, you will need to adhere to the updated rules.

Immigration New Zealand says the changes aim to provide clearer boundaries around open work rights and improve compliance across New Zealand’s immigration system.
