Islamabad municipal corporation mayor files petition against CDA – Pakistan

The mayor of Metropolitan Corporation Islamabad (MCI), Sheikh Anser, filed an appeal on Monday at the Supreme Court against the Capital Development Authority (CDA), saying the latter had not handed over powers to which the MCI was entitled under the Islamabad Local Government Law, 2015.

The petition, filed by lawyer Ahmed Nawaz on behalf of Anser, said the MCI still could not make appointments, collect property taxes or manage and control assets in the capital, despite the fact that the agency had obtained powers under of the aforementioned act. The petition also said that no development funds had been allocated to the MCI, because the municipal agency was "disabled to deal with municipal affairs." […] cleaning, waste disposal, etc. ".

The mayor also accused the CDA of "interfering" with the publication and transfer of MCI employees.

"The publication and transfer of employees is, on paper, controlled by the MCI; however, it is practically the CDA that interferes in such matters with the help and assistance of the CBA Union," the petition reads.

In addition, he said that while the CDA had transferred its obligations to MCI, it had not delivered the assets of "nefarious designs."

"All assets that have been transferred to the MCI are not, in fact, outside the goodwill of the CDA to comply with the law; rather they are a liability and the assets that should actually be transferred to the MCI have been retained by the CDA for nefarious designs, which lack any legal basis or authority. "

The petitioner urged the court to order the Ministry of Interior to divide and hand over the authority and powers to which the MCI was entitled under the law.

"The federal government [should] be directed to allocate a budget to MCI, and employees transferred to MCI will be subject to MCI control in matters of discipline, transfer and publication for the proper functioning of the corporation, "said the petition.
