The UK authorities also agreed to present British witnesses to the Pakistani court to testify in the case of murder.<\/p>\n<p>Among the evidence received from the Central Authority of the United Kingdom are CCTV images of the murder incident, forensic and post mortem reports, recovery memorandum, statements of the investigative officer and 23 witnesses.<\/p>\n<p>The prosecution informed the ATC that of 23 British witnesses, three would appear before the ATC to testify in this case, while the rest would record their statements through the video link. These three witnesses are the officers of the Counter-Terrorism Command (CTC), or SO15, which is a branch of Specialized Operations within the London Metropolitan Police Service.<\/p>\n<p>ATC judge Shahrukh Arjumand will examine the evidence on Friday (today).<\/p>\n<blockquote>\n<p>The leader of MQM was stabbed in 2010 in London<\/p>\n<\/blockquote>\n<p>According to Khawaja Imtiaz, special prosecutor in the case of murder of Imran Farooq, after receiving new evidence, the court will decide to reconsider the charges against the suspects or not.<\/p>\n<p>In September, Toby Cadman, a lawyer from the government of Pakistan, confirmed that after a request for Mutual Legal Assistance (MLA) to transfer relevant evidence to the investigation of the murder of Dr. Farooq&#39;s death, the FIA \u200b\u200bteam received a letter of acceptance of the Central Authority States of the Kingdom confirming the transfer of evidence held by the authorities of the United Kingdom.<\/p>\n<p>Initially, the UK authorities did not respond to Pakistan&#39;s MLA request. The UK government was reluctant to hand over the evidence to Pakistan since European laws did not allow sharing evidence with a country where the crime was punishable by death.<\/p>\n<p>However, the Pakistani government assured the United Kingdom government that if they were found guilty, the accused would not receive the death penalty and would also be guaranteed the amendment of the law.<\/p>\n<p>Earlier this month, a member of the National Assembly belonging to the ruling Pakistan Tehreek-i-Insaf (PTI) presented a bill in the assembly that excludes the death penalty in cases where evidence of a foreign jurisdiction was presented .<\/p>\n<p>The murder suspect trial has been paralyzed since last year due to lack of availability of evidence.<\/p>\n<p>Last year, the High Court of Islamabad had ordered the ATC of Islamabad to conclude the very late trial for October 2018.<\/p>\n<p>However, the FIA \u200b\u200bprosecutor repeatedly requested the court to extend the deadline since the British government was reluctant to share evidence related to the murder, for fear that the defendant could be sentenced to death if convicted.<\/p>\n<p>Two suspects in the case, Khalid Shamim and Syed Mohsin Ali, have registered their confessional statements before the magistrate, saying that Dr. Farooq was killed because it was a &quot;powerful threat to the leadership of the MQM.&quot; However, recently, these suspects have backed away from their confessional statement, saying they recorded the previous statement under duress.<\/p>\n<p>Another suspect, Moazzam Ali, has not yet registered his confessional statement in the case.<\/p>\n<p>The ATC accused the defendants under various sections of the Pakistan Criminal Code (PPC) and the Anti-Terrorism Act (ATA) of 1997, related to the murder, incitement and plot of a conspiracy to kill.<\/p>\n<p>On December 5, 2015, the FIA \u200b\u200bfiled a case against the founder of MQM and other party leaders for his alleged involvement in the 2010 murder.<\/p>\n<p>Dr. Farooq, one of the main leaders of the MQM, was murdered in front of his home in London in 2010.<\/p>\n<p><em>Posted on Dawn, October 11, 2019<\/em><\/p>\n<\/p><\/div>\n<\/pre>\n<\/pre>\n<p>Source: https:\/\/www.dawn.com\/news\/1510203\/imran-farooq-murder-case-evidence-submitted-in-court<\/p>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The Federal Investigation Agency (FIA) finally presented vital evidence received from the United Kingdom related to the murder case of the leader of the Muttahida Qaumi Movement (MQM) Dr. Imran Farooq in the anti-terrorism court (ATC).
