KARACHI: The International Commission of Jurists (ICJ) denounced the promulgation of the Khyber Pakhtunkhwa Actions Ordinance (in aid of civil power), 2019, by the governor of Khyber Pakhtunkhwa on August 5 and expressed apprehension that could lead to serious humans. violations of rights and the miscarriage of justice, against the supposed objectives of the measures. <\/p>\n
"The ordinance is yet another example of Pakistan's recourse to" exceptional "measures that are extremely incompatible with human rights protections, apparently to combat terrorism and other serious crimes," said ICJ director in Asia, Frederick Rawski, according to a press release issued on Friday. <\/p>\n
"Pakistan must reject this dangerous, oppressive and counterproductive strategy and, instead, strengthen its judicial process and the application of the law in accordance with its domestic law and its international human rights obligations," he added. <\/p>\n
\nHe says the legislation can lead to serious violations of rights and a judicial error<\/p>\n<\/blockquote>\n
The ICJ urged the government of Pakistan to immediately revoke the ordinance and review all national security legislation to ensure that it is fully compatible with international human rights laws and regulations. <\/p>\n
The press release said the ordinance granted radical powers to members of the military, including the power to detain people without charge or trial for several vaguely defined reasons in which it seemed that such "internment" would be convenient for peace. People could be detained for an unspecified period without any right to appear before a court of law or challenge the legality of detention before a court, he added. <\/p>\n
The ordinance is incompatible with the "fundamental rights" guaranteed by the Constitution, as well as with Pakistan's international legal obligations, even under the International Covenant on Civil and Political Rights (ICCPR), the ICJ said. <\/p>\n
Article 9 (4) of the ICCPR guarantees the right of all detainees to initiate proceedings before a court to challenge the legality of their detention, and to be released if the court considers such detention illegal. <\/p>\n
Earlier in its review of Pakistan's implementation of the ICCPR and the Convention against Torture (CAT) in 2017, the UN Human Rights Committee and the UN Committee against Torture had expressed concern over the Action Regulations ( in aid of the civil power) in 2011, which were applicable in the former tribal areas administered by the federal government and in the tribal areas administered by the province, and recommended that Pakistan "revise the Regulation of actions (in aid of civil power) of 2011 with a view to repealing it or bringing it into compliance with international standards. " <\/p>\n
Mr. Rawski said: "It is regrettable that Pakistan has not only ignored these recommendations of the UN Committees, but has expanded the scope of the regulations." He added that this step also questioned Pakistan's promise of election to the UN Human Rights Council in 2017, where Pakistan had "firmly resolved to defend, promote and safeguard universal human rights and fundamental freedoms for all."<\/p>\n
