The Islamabad High Court (IHC) on Friday accepted the apologies of Dr. Firdous Ashiq Awan, special assistant to the prime minister in information and dissemination, for shocking the judiciary and issued a new contempt of court for making a statement about a criminal pending proceed.<\/p>\n
During the contempt hearing of the judicial notice, chaired by the President of the Supreme Court of Justice of IHC, Athar Minallah, the prime minister's special assistant had presented an unconditional apology for "shocking the judiciary," which the higher court accepted more late.<\/p>\n
Judge Minallah told Awan that she had committed contempt of court for two reasons: one for ridiculing the court for considering the case as a "special dispensation" and another for trying to influence a pending court proceeding related to the petition for freedom on bail for Nawaz. <\/p>\n
Awan assured the court that he would be extremely careful in the future and placed himself at the mercy of the court.<\/p>\n
The IHC Supreme Court president commented that Prime Minister Imran Khan had fought for the rule of law, adding that he was sure that the Prime Minister had never ordered him to use that language against the court.<\/p>\n
While accepting his apology for shocking the judiciary, the court issued a new disrespect notice to Awan and ordered him to satisfy the court that his press conference did not intend to influence a pending judicial proceeding.<\/p>\n
"[We] You cannot ignore matters when the principles of a fair trial are opposed, "said Judge Minallah.<\/p>\n
The IHC requested your response on Monday. In addition, the court ordered him to appear in court on November 5. Awan requested that the proceedings be postponed until after Tuesday due to a cabinet meeting; however, the court rejected the request and said that since it is a criminal proceeding, its appearance is mandatory.<\/p>\n
After the proceedings, Awan arrived and inspected a district court, according to IHC orders.<\/p>\n
On Wednesday, a justified cause notice was issued to Awan under Section 3 of the contempt of court ordinance of 2003. He said that Awan had defamed the IHC while saying that the hearing of a petition on the release of the former Prime Minister Nawaz Sharif was "a special dispensation."<\/p>\n
The court had ordered Awan to appear in person today to explain why it should not be prosecuted against contempt laws.<\/p>\n
On October 26, the president of PML-N, Shehbaz Sharif, filed a petition at IHC, asking the court to hear the declaration of bail on Nawaz before October 29 due to the "extremely critical condition" of the former Prime Minister. After the hearing, which lasted until the night, the court granted Nawaz bail for medical reasons until October 29 at the Al-Azizia reference.<\/p>\n
Awan, while holding a press after bail, had said the government would want to see such rapid trials for all prisoners under trial and in all cases. "We hope this new trend is applicable to all cases," he said.<\/p>\n
The special assistant also commented that there was no precedent in the past that the executive was asked to take responsibility for the health of a prisoner, referring to the questions of the judges during Saturday's hearing. "We are not responsible for their old ailments, including blood pressure and heart problems," Awan had said.<\/p>\n
The IHC on Tuesday resumed the declaration of bail and granted bail after Nawaz was arrested after suspending his sentence. The court allowed bail to the former prime minister for eight weeks and asked him to seek further extension of the Punjab government.<\/p>\n<\/p><\/div>\n<\/pre>\n<\/pre>\n
