{"id":11298,"date":"2019-11-01T07:13:19","date_gmt":"2019-11-01T02:13:19","guid":{"rendered":"http:\/\/umang.pk\/2019\/11\/pemra-bar-on-fazl-presser-coverage-illegal-phc-pakistan\/"},"modified":"2019-11-01T07:13:19","modified_gmt":"2019-11-01T02:13:19","slug":"pemra-bar-on-fazl-presser-coverage-illegal-phc-pakistan","status":"publish","type":"post","link":"https:\/\/umang.pk\/ur\/2019\/11\/01\/pemra-bar-on-fazl-presser-coverage-illegal-phc-pakistan\/","title":{"rendered":"Pemra bar on Fazl presser coverage illegal: PHC &#8211; Pakistan"},"content":{"rendered":"<p><img decoding=\"async\" src=\"http:\/\/umang.pk\/wp-content\/uploads\/2019\/11\/Pemra-bar-on-Fazl-presser-coverage-illegal-PHC-Pakistan.jpg\" alt=\"\" title=\"\"><\/p>\n<div>\n<p>PESHAWAR: The Peshawar High Court ruled that the Pakistan Electronic Media Regulatory Authority&#39;s act of preventing television channels from broadcasting the press conference of Jamiat Ulema-i-Islam-Fazl chief Maulana Fazlur Rehman was illegal and a violation of the Constitution and Ordinance of Pemra 2002.<\/p>\n<p>A bank composed of the President of the Supreme Court, Waqar Ahmad Seth, and Judge Ahmad Ali ruled that the bar on media coverage of the JUI-F press violated Article 19 of the Constitution and Section 27 of the Pemra Ordinance.<\/p>\n<p>The bank issued a brief order on October 29 to accept the request of the lawyer and leader of the JUI-F, Obaidullah Anwar, who challenged Pemra&#39;s act of preventing news channels from transmitting the Fazl press conference through verbal orders and asked the court to declare it. Illegal and unconstitutional<\/p>\n<p>In the detailed trial, the bank cited the provisions of the Pemra Constitution and Ordinance, 2002, and ordered Pemra to ensure that private television channels transmit opposition activities to the government.<\/p>\n<blockquote>\n<p>The court observes that the channels may file contempt of contempt if said restraining orders are issued again<\/p>\n<\/blockquote>\n<p>The bank noted that if a channel was told again not to cover the press conference of the JUI-F leader, the petitioner could file a petition for contempt of court.<\/p>\n<p>Citing Section 27 of the Pemra Ordinance, the bank ruled that such provision clearly revealed that the authority should, in order, in writing, prohibit any means of transmission or distribution service operator.<\/p>\n<p>However, he said the case records would reveal that there were no such written orders and, instead, Pemra verbally instructed all television channels not to broadcast the press conference of the JUI-F leader, which was a clear violation of law.<\/p>\n<p>The bank noted that article 19 of the Constitution stipulates that all citizens have the right to freedom of expression and expression, etc.<\/p>\n<p>He referred to a ruling of the Supreme Court in a case of Dr. Shahid Masood et al. (2010 SCMR 1849) in which it was stated that the role assigned to electronic media was derived from the fundamental rights of freedom of expression, expression and Press guaranteed by Article 19 of the Constitution.<\/p>\n<p>In the same ruling, the court ruled that just as important, if not more, was the right of every citizen to have access to information in all matters of public importance, as guaranteed by article 19-A of the Constitution.<\/p>\n<p>Meanwhile, the court also issued the detailed ruling in two other petitions, one filed by Obaidullah Anwar and another by Azmat Ali Mohmand against the placement of shipping containers on the roads to block demonstrations bound for Islamabad to join the Azadi March of JUI-F.<\/p>\n<p>The bank had accepted the two petitions on October 29.<\/p>\n<p>In the detailed order, the bank ruled that the act of respondents, including the provincial government, to place containers to block the roads to Islamabad was illegal and without legal authority.<\/p>\n<p>He asked respondents to open the roads immediately by removing containers to the vicinity of Khyber Pakhtunkhwa province.<\/p>\n<p>However, the bank ordered the petitioners to grant a bond to the additional (judicial) registrar of the higher court to declare that the protesters will remain peaceful and will not damage public and government property.<\/p>\n<p>He referred to articles 15, 16 and 17 of the Constitution that observed that these provisions guaranteed freedom of movement, the peaceful gathering of persons and the formation of associations or unions.<\/p>\n<p><em>Published on Dawn, November 1, 2019<\/em><\/p>\n<\/p><\/div>\n<\/pre>\n<\/pre>\n<p>Source: https:\/\/www.dawn.com\/news\/1514122\/pemra-bar-on-fazl-presser-coverage-illegal-phc<\/p>\n","protected":false},"excerpt":{"rendered":"<p>PESHAWAR: The Peshawar High Court ruled that the Pakistan Electronic Media Regulatory Authority&#39;s act of preventing television channels from broadcasting the press conference of Jamiat Ulema-i-Islam-Fazl chief Maulana Fazlur Rehman was illegal and a violation of the Constitution and Ordinance of Pemra 2002.
