ISLAMABAD: Weeks after the release of three suspects by a local court on the recommendation of the Federal Investigation Agency, the FIA \u200b\u200brequested the special judge of a computer crime court to initiate legal proceedings against its own team for committing negligence in the video leak case of the judge.<\/p>\n
In the charge sheet filed with the cybercrime court on Monday, the FIA \u200b\u200bblamed its four officers, including the prosecutor, for committing negligence in the investigation of the case related to the alleged immoral video of former accountability judge Mohammad Arshad Malik and requested legal proceedings against them.<\/p>\n
Judge Malik, who had condemned former Prime Minister Nawaz Sharif in Al-Azizia's reference, in an alleged video confession stated that he had been pressured and blackmailed to issue a decision against the former prime minister in the reference due to his video allegedly immoral. After filtering the statement on video, the judge in an FIR filed with the FIA \u200b\u200bnominated Nasir Janjua, Maher Ghulam Jilani and Khurram Yousaf.<\/p>\n
Initially, the FIA \u200b\u200barrested Mian Tariq in connection with the leaking of the judge's video, while the three suspects were arrested on September 2 after the special judge of the IT crime court, Tahir Mehmood Khan, dismissed his statement of freedom. on bail prior to arrest. However, at the FIA's request for "the release of the accused," a judicial magistrate ordered his release on September 7.<\/p>\n

In the discharge report, the FIA \u200b\u200binvestigation officer had stated that during the course of the investigation, "they [the three accused persons] they were found not involved in the commission of crimes directed against them in the case … and the charges against them could not be established. The FIA \u200b\u200bprosecutor, Kaleemullah Tarrar, supported the position of the investigating officer that the defendants' case was in a position to be discharged as there was no evidence available against him.<\/p>\n
Subsequently, the civil judge \/ judicial magistrate Saqib Jawad observed that with "the statements of the parties and the material available in the registry, it is evident that there is not a single available evidence in the registry against the present defendant." The court said that resubmitting them in judicial custody would be useless, since the accusation was firm that no single evidence and incriminating material was available in the registry.<\/p>\n
"As a result, the defendants … are dropped from this case and released immediately if it is not required in any other case," the court ruled.<\/p>\n
The director general of the FIA \u200b\u200bthen transferred the investigation to the anti-terrorism wing.<\/p>\n
Since the trial of the principal suspect was underway before the special judge of the IT crimes court, Judge Khan expressed his dissatisfaction with the release of the three persons and requested the investigation team's charge sheet.<\/p>\n
The FIA \u200b\u200bon the charge sheet filed Monday accused its director Afzal Butt, assistant director Farooq Latif, Fazal Mehboob and prosecutor Kaleemullah Tarrar for showing negligence in the investigation that resulted in the release of the three suspects. The FIA \u200b\u200bsought legal proceedings against the officers.<\/p>\n
Other proceedings in the matter were suspended until September 30.<\/p>\n
