The Islamabad High Court (IHC) on Monday suspended a presidential notification of the appointment of two members of the Electoral Commission of Pakistan (ECP) and ordered the parliament to resolve the matter.<\/p>\n
The president of the Supreme Court of IHC, Athar Minallah, said the matter should be resolved quickly when the chief election commissioner was about to retire. The head judge of the CEC, Sardar Muhammad Raza, will retire on December 7.<\/p>\n
"Resolve this matter before December 7 and tell the court," the judge told the additional attorney general.<\/p>\n
The higher court is listening to a petition filed by lawyer Jahangir Khan Jadoon against the controversial and unilateral appointments of members of the Sindh and Baluchistan PCE by President Dr. Arif Alvi. <\/p>\n
According to the petitioner, the criteria for the appointment of the principal commissioner and the members of the election had been established in the Constitution and the notification issued for the appointment of the members on August 22 violated articles 213 and 218 of the Constitution.<\/p>\n
In a previous hearing on the case, Judge Minallah said the matter must be resolved by parliament and that the president of the National Assembly and the president of the Senate should resolve the issue through consultations. <\/p>\n
Following the instructions of his judge Minallah, the president of the National Assembly, Asad Qaiser, and the president of the Senate, Sadiq Sanjrani, met with the legal team of the government and the constitutional experts and decided that the opposition parties will commit to solve the problem.<\/p>\n
During today's hearing, the IHC chief judge asked about the progress of the consultation meetings. The additional attorney general informed him that three meetings between Qaiser and Sanjrani had been held so far, but "no progress could be made due to the deterioration [law and order] "He was referring to the current anti-government sitting & # 39; Azadi March & # 39; directed by Jamiat Ulema-i-Islam-Fazl (JUI-F) Chief Fazlur Rehman and supported by opposition parties.<\/p>\n
"The issue to which it refers must also be resolved in parliament," said Judge Minallah.<\/p>\n
"How much longer do the president of the National Assembly and the president of the Senate require?" asked the senior judge of IHC, regretting that this ECP was "almost non-functional". <\/p>\n
"Four more weeks must be granted," said additional attorney general Tariq Mehmood Khokhar. <\/p>\n
The judge ordered Khokhar to inform the court about the progress in the matter before December 5 and postponed the hearing until then.<\/p>\n
President Dr. Arif Alvi, on August 22, appointed Khalid Mehmood Siddiqui of Sindh and Munir Ahmed Kakar of Balochistan against two of the vacant positions previously occupied by Abdul Ghaffar Soomro and retired judge Shakeel Baloch of the respective provinces.<\/p>\n
The head of the electoral commission (CEC) refused to administer the oath to both designated members and wrote a letter to the law ministry, saying that the appointment of PCE members did not agree with the relevant articles of the Constitution.<\/p>\n<\/p><\/div>\n<\/pre>\n<\/pre>\n
