ISLAMABAD: The High Court of Islamabad (IHC) on Monday sought an explanation from the Interior Ministry for banning Ansarul Islam, the Jamiat Ulema-i-Islam-Fazl (JUI-F) volunteer group, without giving it a chance to defend itself. <\/p>\n
The president of the Supreme Court of IHC, Athar Minallah, after hearing preliminary arguments on a petition postponed Tuesday (today) with an address, "an authorized representative of the Ministry of Interior will appear in person and explain how the contested notification has been issued without providing the opportunity to listen. \u201d <\/p>\n
The court order also states: "The representative who appears on behalf of the federation will also satisfy this court that before the issuance of the notification, efforts were made to determine the independent existence of an organization with the name of Ansarul Islam." <\/p>\n
On October 24, the federal government authorized the provinces to take appropriate measures against Ansarul Islam, claiming that it is capable of functioning as an "armed wing of the organization." <\/p>\n

The JUI-F through its lawyer Kamran Murtaza filed the petition with the IHC. <\/p>\n
Arguing in court, Murtaza said that Ansarul Islam was an informal group of workers from a registered political party, called JUI-F, and that it did not have an independent existence. <\/p>\n
He said that the interior ministry made the decision without giving the opportunity to listen and determine the facts related to the independent existence of Ansarul Islam. <\/p>\n
According to the petition, for fear that the Azadi march of JUI-F would gain momentum, the government had begun a vicious campaign against it by using several methods to stop the march. <\/p>\n
He mentioned government actions, such as the use of state institutions, such as Pemra to issue verbal instructions to the media to completely prohibit the transmission or presentation of speeches by JUI-F leaders, and government officials openly threaten the use of force to stop protests. or trying to put their leaders in the custody of NAB. <\/p>\n
The petition said that the government was trying to create panic among people by issuing a video threat alert of a letter issued by the National Anti-Terrorism Authority, claiming the threat of a terrorist attack. <\/p>\n
The petition said that a notice of justified cause was not issued to the petitioner or Ansarul Islam before the issuance of contested notifications, and the right to a hearing was denied. <\/p>\n
The Private Military Organizations (Abolition and Prohibition) Act of 1974 does not provide any mechanism in which an aggrieved person or organization can appeal or request the revision of the federal government's decision, turning it into legislation against the fundamental rights enshrined in the Constitution and capable of being declared null ab initio. <\/p>\n
According to the petition, the JUI-F is registered in the ECP and Ansarul Islam is also mentioned in the constitution of the party presented to the Commission.<\/p>\n
