IHC restores Mushtaq Ahmed Sukhera as tax ombudsman – Pakistan

The High Court of Islamabad (IHC) on Thursday restored Mushtaq Ahmed Sukhera as Federal Ombudsman (FTO) with immediate effect, declaring null and void notification of the ministry of law for removal.

The law ministry had eliminated Sukhera in June. He had been appointed in August 2018 for a period of four years.

The president of the Supreme Court of IHC, Athar Minallah, announced the decision, which had previously been reserved.

After serving 30 years in the police department, Sukhera retired as Inspector General Police (IGP) Punjab in 2017. Later, then-Prime Minister Shahbaz Sharif appointed him as an advisor to the police department.

In 2018, he was appointed defender of the federal people. In June, the law ministry withdrew him from his post. The measure, however, was questioned in the IHC. The superior court, on June 14, had issued a suspension against the government's decision.

Although Sukhera was removed from office by notification, Section 5 of the Institutional Reform Act of the Federal Ombudsman of 2013 says: "An Ombudsman can be removed from office through the Supreme Judicial Council for being unable to properly perform the duties of his office in the position for physical or mental disability or for having been convicted of misconduct. "

According to a media report, citing sources, Sukhera's participation in the Lahore Model Town incident, in which more than a dozen people died, had led to his removal from the post. Last year, an anti-terrorism court had accused Sukhera and 115 other police officers in connection with their alleged role in the June 2014 tragedy.

However, sources were cited as saying that it was not only the case of Model Town that led to the dismissal of Sukhera; His frequent decisions against Federal Revenue Board (FBR) officials had also played a role.

The Federal Tax Advocate Ordinance, 2002, empowers you to proceed with a "complaint of any aggrieved person, or with a reference from the president, the Senate or the National Assembly, as the case may be, or by motion of the Supreme Court or a Superior Court conducted during the course of any proceeding before him or on his own initiative, investigates any allegations of mismanagement by the Income Division or any Tax Employee. "

According to sources, some senior FBR officials had presented a representation against Mr. Sukhera to President Dr. Arif Alvi, which led to the dismissal.
