Petition to prevent changing PCB constitution dismissed

The Lahore High Court appears to have cleared up the last hurdle in the long domestic reform of the PCB after dismissing the plea to prevent the Commission's new constitutional change. This allows the PCB not only to fully implement the new constitution, but also to reform the board of directors and start restructuring domestic establishment from September 14.

Following the interim judgment of the court on 23 August, the new constitution was suspended for five days. The main complaint of the Writ petition was the PCB election and the election of the vice-president of the district elections and the investigation of the cricket club. Another petition for the termination of four coaches by the PCB was added to the muddle, and the third application against the new constitution seemed to further complicate the intent of the petitioner's application.

The court observed that if the petitioner complained about the execution of the order, the PCB must be approached to resolve it, and if the PCB is not compliant, the court can be approached again.

Taffazul Rizvi, PCB legal counsel, told ESPNcricinfo that "about 20 petitions were dismissed." "The letter was merciless, and there was no value in the written paper. The petition lost legal grounds and was charged with the dismissal of the PCB employee and the district president.

"The PCB will not be taken hostage by anyone, and the new constitution will be in full force. Wrong induction to the new constitution will be defended with full legal legitimacy."

This case assumed importance because Zaka Ashraf, then chairman of the time, was dismissed by Islamabad High Court, almost taking the PCB in a situation similar to 2013. The court not only dismissed him later, but also adjusted the constitution himself. After going back and forth several times, the result of that power tussle was Najam Sethi, ending with the PCB chairman Najam Sethi kept on until last year.

The new PCB configuration, notified on August 19 by the Pakistani government, changed the overall structure of the board, there were maintenance of the domestic structure and other major updates. This is the fifth since 1995 and the fourth of the last 12 years, when the PCB configuration has been revised. The new legislation has reduced the almost authoritarian powers of the PCB chairman, and most of them have been passed on to newly appointed executive directors to share power more effectively and reduce conflicts of interest.

Chairman of the Board has begun to change Esan Mani. Until now, the president had the authority to act as a board member to enforce the policies he proposed. It also undermined the power of its own prime minister, a prime minister who is not authorized to dismiss the board or remove its chair.

Mr. Marney said, “PCB welcomes the decision of Supreme Court Justice Judge Lahore High Court of Justice, who dismissed the 2019 constitution suspension.

"To all knowledgeable and passionate cricket fans and followers it was clear that the intentions of the petitioners were Malafde and aimed to disrupt Pakistan's cricket activity and embarrass the PCB and the country.

"The 2019-20 season will be a celebration season for Pakistani cricket fans hosting Sri Lanka for three ODIs and many T20Is from September 27th to October 9th. The Higher Delegation Board will be visiting in September and October respectively as part of preparations for the upcoming trip to Pakistan. "
